FutureMVP — AI Athlete Assessment Platform

This End-User License Agreement and Terms of Service ("Agreement") is a legal agreement between you ("User," "you," or, where you are registering or acting on behalf of a minor, "Parent/Guardian") and FutureMVP SRL, a company organized under the laws of Romania, with registered address at Sat Bănești, Prahova County, DN1, No. 42, Postal Code 107050, Romania ("FutureMVP," "we," "us," or "our"), governing your access to and use of the FutureMVP website, mobile-optimized web application, and related AI-powered athletic assessment services (collectively, the "Service").
BY CREATING AN ACCOUNT, UPLOADING CONTENT, OR OTHERWISE USING THE SERVICE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THIS AGREEMENT, INCLUDING THE DISCLAIMERS AND LIMITATIONS OF LIABILITY IN SECTIONS 6, 8, AND 9. IF YOU DO NOT AGREE, DO NOT USE THE SERVICE.
FutureMVP allows users to upload videos and photographs of youth and adult athletes performing standardized physical tests (e.g., sprint speed, standing long jump, single-leg balance, eye-hand coordination, and body posture/measurement assessments). The Service uses computer vision and pose-estimation software (including MediaPipe-based biomechanical analysis) to extract movement and body-measurement data from the uploaded media, and uses artificial intelligence (including large language models) to generate natural-language summaries intended to help coaches, parents, and athletes understand relative athletic performance and general movement/posture characteristics.
The Service is designed for use by, or on behalf of, youth athletes, coaches, and parents, as well as adult athletes who choose to use it for personal performance tracking.
THE SERVICE IS NOT A MEDICAL DEVICE AND DOES NOT PROVIDE MEDICAL, HEALTH, DIAGNOSTIC, THERAPEUTIC, OR PROFESSIONAL COACHING ADVICE.
The AI-generated summaries, scores, and any references to posture, symmetry, balance, or biomechanics are general, automated, informational observations derived from video-based pose estimation. They are not clinical assessments and must not be interpreted as a diagnosis of any injury, physiological condition, developmental issue, orthopedic problem, or disease.
Any indication of possible physical asymmetry, imbalance, or movement irregularity generated by the Service is provided solely as a general-interest, educational observation and is not a substitute for evaluation by a licensed physician, physical therapist, orthopedist, or other qualified healthcare professional.
References to "talent identification" or athletic potential reflect an automated comparison of measured performance metrics and are inherently limited by video quality, camera angle, the athlete's effort on the day of recording, growth and developmental stage, and the underlying model's accuracy. They are not predictions of future athletic success and should not be used as the sole or primary basis for any decision regarding an athlete's training, health, recruitment, or participation in sport.
You should always consult a qualified healthcare professional before making any decision based on information suggesting a possible physiological, orthopedic, or developmental concern, and before beginning, modifying, or continuing any exercise or training program, particularly for children.
The Service is intended to be used by adults (18 years or older) who create and control accounts, and by parents, legal guardians, or authorized coaches/organizations who upload media and data concerning minor athletes.
If you upload video, photographs, or other data concerning a person under the age of 18, you represent and warrant that you are that minor's parent or legal guardian, or that you have obtained verifiable consent from the minor's parent or legal guardian to submit such data for analysis under this Agreement, in compliance with applicable law (including Regulation (EU) 2016/679 (GDPR) and Romanian Law no. 190/2018).
You are responsible for ensuring that the collection and processing of a minor's image, video, and biomechanical data through the Service is lawful in your jurisdiction and, where required, that appropriate parental/guardian consent has been obtained and documented before submission.
We do not knowingly permit minors to independently create accounts or submit their own data without parental/guardian involvement. If we become aware that a minor has created an account without such involvement, we reserve the right to suspend or delete that account and associated data.
"User Content" means all videos, photographs, athlete profile information (including name, age, height, weight, and wingspan), and other materials or data you upload to or submit through the Service.
You retain ownership of your User Content. By submitting User Content, you grant FutureMVP a limited, non-exclusive, worldwide, royalty-free license to store, process, analyze, reproduce, and display that User Content solely for the purposes of (a) operating and providing the Service to you, (b) generating the requested biomechanical analysis and AI-generated summaries, (c) maintaining your session history, and (d) as otherwise described in this Agreement or our Privacy Policy.
You represent and warrant that you own or have all necessary rights, consents, and permissions (including the consent of any identifiable individual depicted, or their parent/guardian if a minor) to upload the User Content and to grant the license above.
You must not upload content depicting any person without that person's knowledge and appropriate consent (or, for minors, the consent of a parent/guardian), and you must not upload content depicting any third party who has not agreed to be assessed through the Service.
Our collection and use of personal data, including athlete media and derived biomechanical data, is described in our Privacy Policy, which is incorporated into this Agreement by reference. Key points relevant to this Agreement include:
Facial privacy: The Service is designed to automatically blur faces on stored and displayed photographs and videos, as a privacy safeguard. Full, unblurred media is used transiently during automated analysis for accuracy, and is not retained unblurred except where you have expressly disabled the face-blur setting for your account in Account Settings.
User control: You may enable or disable automatic face-blurring for your account at any time via the Account page. If you disable face-blurring, faces will remain visible in stored and displayed media for your account's submissions, and you assume responsibility for that choice, including with respect to any minors depicted.
Storage: Media and analysis results are stored using cloud infrastructure (including object storage and search-indexing services) and retained until you or an authorized administrator deletes them, or as otherwise described in our Privacy Policy.
Access: Each user may generally access only their own session history. Administrative users designated by FutureMVP may access and, upon request, delete any user's stored media and results for support, moderation, or legal-compliance purposes.
You may request access to, correction of, or deletion of your personal data and your minor athlete's data by contacting us at privacy@future-mvp.com, consistent with your rights under applicable data protection law.
POSE-ESTIMATION AND AI-GENERATED CONTENT MAY BE INACCURATE, INCOMPLETE, OR UNREPRESENTATIVE.
Computer-vision measurements (e.g., estimated distance, speed, joint angles, symmetry, and body measurements) are approximations derived from two-dimensional video and are affected by camera angle, lighting, clothing, calibration references visible in the video, and the athlete's technique. They should be treated as estimates, not precise or certified measurements.
AI-generated natural-language summaries are produced by third-party large-language-model technology and may occasionally be factually incorrect, incomplete, or inconsistent with the underlying numeric data ("hallucination"). You should independently verify any output before relying on it for any consequential decision.
The Service is provided for informational, educational, and entertainment purposes related to general athletic performance tracking, and outputs must not be relied upon as the sole basis for medical, coaching, recruitment, insurance, or eligibility decisions.
Certain features of the Service (e.g., submitting a test session for analysis) require account credits. New accounts are provided an initial allotment of free credits; additional credits may be purchased through payment mechanisms we make available from time to time.
Credits are consumed upon successful submission of a test session and, except as required by applicable consumer-protection law or as we otherwise state at the time of purchase, are non-refundable and non-transferable.
If a submission fails to be queued for processing due to a technical error on our part, any credits deducted for that submission will be automatically refunded to your account.
We reserve the right to change credit pricing, allotments, or the credit cost of any feature at any time, with notice provided through the Service or by email where required by law.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OR ERROR-FREE OPERATION. WE DO NOT WARRANT THAT THE SERVICE, OR ANY ANALYSIS, SCORE, OR AI-GENERATED CONTENT IT PRODUCES, WILL BE ACCURATE, RELIABLE, COMPLETE, OR FIT FOR ANY PARTICULAR PURPOSE, INCLUDING TALENT IDENTIFICATION OR THE DETECTION OF ANY PHYSIOLOGICAL CONDITION.
Nothing in this Agreement excludes or limits any warranty, right, or remedy that cannot lawfully be excluded or limited under applicable law, including mandatory consumer-protection rights available to consumers in Romania and the European Union.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FUTUREMVP, ITS OFFICERS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR OPPORTUNITY (INCLUDING ATHLETIC, SCHOLARSHIP, OR RECRUITMENT OPPORTUNITY), ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SERVICE OR ANY AI-GENERATED CONTENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THIS AGREEMENT OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) FIFTY EUROS (€50).
Nothing in this Agreement limits liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable Romanian or EU law.
You agree not to:
Upload content depicting any individual without appropriate consent, or in violation of any third party's privacy or publicity rights;
Use the Service to make, or attempt to make, any medical, diagnostic, or eligibility determination regarding a real individual, or to hold out any Service output as a certified or professional assessment;
Attempt to circumvent, disable, or interfere with the face-blurring, security, or access-control features of the Service;
Use the Service to harass, exploit, or endanger any minor, or upload content that is unlawful, exploitative, or inappropriate;
Reverse-engineer, scrape, or use automated means to extract data or the underlying models from the Service, except as permitted by applicable law;
Use the Service in any manner that violates applicable law, including data-protection, child-safety, or consumer-protection law.
The Service, including its software, AI models, analysis methodology, visual design, and all related intellectual property (excluding your User Content), is owned by FutureMVP or its licensors and is protected by applicable intellectual-property laws. Except for the limited right to use the Service as permitted by this Agreement, no rights are granted to you.
You may stop using the Service and request deletion of your account and data at any time by contacting us at contact@future-mvp.com.
We may suspend or terminate your access to the Service, with or without notice, if we reasonably believe you have violated this Agreement, applicable law, or pose a risk to the safety of any minor or other user.
Upon termination, your right to use the Service ceases immediately; provisions of this Agreement that by their nature should survive (including Sections 2, 6, 8, 9, and 14) will survive termination.
We may update this Agreement from time to time to reflect changes to the Service or applicable law. We will provide notice of material changes through the Service or by email. Continued use of the Service after changes take effect constitutes acceptance of the revised Agreement.
This Agreement is governed by the laws of Romania, without regard to its conflict-of-laws principles, without prejudice to any mandatory consumer-protection provisions of the law of the country in which you, as a consumer, are habitually resident. Any dispute arising out of or relating to this Agreement shall be subject to the exclusive jurisdiction of the competent courts of Romania, unless mandatory law provides you with the right to bring proceedings in the courts of your own country of residence.
Entire Agreement: This Agreement, together with our Privacy Policy, constitutes the entire agreement between you and FutureMVP regarding the Service.
Severability: If any provision of this Agreement is found unenforceable, the remaining provisions will remain in full force and effect.
No Waiver: Our failure to enforce any provision shall not constitute a waiver of that provision.
